Are Court Records Public in St. Charles Parish?

Under the Louisiana Public Records Law (La. R.S. 44:1 et seq.), any person of the age of majority has the right to examine and obtain copies of public records produced by government bodies, including courts. Most court records generated in St. Charles Parish are presumptively open to public inspection. The Clerk of Court makes civil, criminal, probate, conveyance, and mortgage records available through both in-person access and the online records portal.

However, certain categories of records are sealed or restricted either by statute or court order. Records that are not available for general public review include:

  • Juvenile proceedings — governed by the Louisiana Children’s Code, these records are confidential and accessible only to parties and authorized personnel.
  • Adoption records — sealed under Louisiana law and accessible only by court order or to specified parties.
  • Records of victims of sexual and domestic violence — identifying information is restricted to protect victim safety.
  • Medical and mental health records — protected from public disclosure under state and federal privacy laws.
  • Records of confidential informants — withheld from public access to protect law enforcement operations and individual safety.
  • Personally identifiable information — Social Security numbers, driver’s license numbers, and similar identifiers are redacted from publicly available records.

Louisiana is also a “closed record” state with respect to vital records. Under La. R.S. 40:41, birth records do not become public until 100 years after the subject’s birth, and death records remain restricted for 50 years after the date of death. Before those thresholds, only authorized individuals (the registrant, immediate family members, legal representatives, or persons with a court order) may obtain certified copies.

St. Charles Parish Criminal Court Records

Criminal cases in St. Charles Parish are prosecuted in the 29th Judicial District Court, which has original jurisdiction over all felonies and misdemeanors. State Criminal History Checks

The Louisiana State Police Bureau of Criminal Identification and Information serves as the statewide custodian of criminal history records. Louisiana law restricts the release of criminal history information to authorized persons and entities. Individual court costs for filing are deducted from the advance deposit and include a $20.00 initialization fee, $6.00 for the first filed page, $4.00 for each subsequent page, and $2.00 per page for exhibits, attachments, and depositions. Property Records

Property records, including conveyances, mortgages, plats, and liens, are maintained by the Clerk of Court’s Mortgage and Conveyance Department and are searchable through the online records portal. Recordation fees for documents filed with the Mortgage and Conveyance Department (effective August 1, 2017, per Act 173) start at $105.00 for documents of 1 to 5 pages, $205.00 for 6 to 25 pages, $305.00 for 26 to 50 pages, and $305.00 plus $5.00 per additional page for documents exceeding 50 pages. These amounts include up to 10 indexed names, a certified copy, and the LCRAA portal fee.

St. Charles Parish Family Court Records

Family law matters in St. Charles Parish — including divorce, child custody, child support, domestic violence protective orders, and adoption — are adjudicated in the 29th Judicial District Court. The court’s three divisions each hear family cases. Divorce Records

Divorce judgments are maintained by the Clerk of Court. These are considered closed records under Louisiana law and can be accessed only by the parties to the proceeding, their legal representatives, or persons with a court order. Marriage Records

Marriage licenses are issued by the Clerk of Court. Key details for applicants:

  1. The fee for a standard marriage license is $35.00; a covenant marriage license costs $45.00. Payment may be made by cash, check, credit card, or money order.
  2. At least one applicant must appear in person. Online applications are available through eClerks LA; after submitting the application online, call the office to schedule an appointment.
  3. Required documents include a certified birth certificate, valid unexpired photo ID, proof of termination of any prior marriage (certified divorce judgment or death certificate), and the last four digits of each party’s Social Security number.
  4. The license is valid for 30 days from the date of issuance. A 24-hour waiting period applies unless waived by a District Judge or Justice of the Peace.
  5. Two witnesses of full age must attend the ceremony.

Certified copies of marriage licenses (for marriages originally issued in St. Charles Parish) cost $7.00. Regular copies are $2.00 per page. The marriage record search fee is $10.00, which includes a certified copy if the record is located.

Birth Certificates

Birth certificates for persons born in Louisiana may be obtained at the Clerk’s office for $34.00 (cash only). A birth card purchased with the certificate costs $48.00 total. A valid driver’s license or state-issued ID is required. An application form is available on the Clerk’s website.

The Clerk’s office does not issue death certificates. Death records must be obtained from the Louisiana Department of Health Vital Records office:

Under La. R.S. 40:41, birth records are restricted for 100 years and death records for 50 years. Only the registrant, immediate family, legal representatives, or persons with court authorization may request certified copies before those periods expire.

Domestic Violence

The 29th JDC processes protective orders in domestic violence cases. St. Charles Parish Probate Court Records

Probate matters in St. Charles Parish — including successions, wills, estate administration, trusts, guardianships, conservatorships, and interdictions — are heard in the 29th Judicial District Court. Louisiana uses the term “succession” rather than “probate” for the legal process of settling a decedent’s estate.

Filing a Succession

Opening a succession requires an advance deposit of $500.00, as set forth in the Clerk’s civil and probate fee schedule. Subsequent pleadings filed without service require a $100.00 deposit; those requiring one service require $200.00. Individual court costs (initialization, filing, indexing, and issuance fees) are deducted from the deposit.
